General Terms and Conditions of Sale for the online shop shop.nendaz.ch

A. Scope of application
These General Terms and Conditions of Sale (GTC) govern the use of the online shop shop.nendaz.ch as well as the contractual relationships between users, customers, service providers and the Société de Développement et l'Office de Tourisme de Nendaz (hereinafter referred to as the “SDN”).
The services published on shop.nendaz.ch do not constitute legally binding offers but rather an invitation to submit a booking or purchase request. The SDN reserves the right to modify the services offered, their descriptions, prices and payment methods at any time or to remove them from the platform.
A.1. Role of the SDN
The SDN operates the online shop shop.nendaz.ch as a marketplace enabling the booking or purchase of tourist services, accommodation, activities, tickets, vouchers or merchandising items.
Intermediary role
For a large part of the services offered, the SDN acts exclusively as a technical and commercial intermediary. In this case:
The contract is concluded directly between the customer and the relevant service provider;
The SDN is not a party to the service contract;
The execution of the service is the sole responsibility of the service provider.
The general terms and conditions, cancellation policies, safety rules, insurance requirements, legal obligations and liabilities of the service provider apply to the service concerned.
No control
The SDN does not systematically monitor the quality, conformity, legality or execution of services offered by third-party providers.
Any claim, warranty request, complaint or legal action relating to the execution of a service must be addressed directly to the relevant service provider.
Service provider’s terms and conditions
With regard to the execution of services, the general or specific terms and conditions of the relevant service provider apply exclusively to the contractual relationship between the customer and the provider. In the event of discrepancies between these GTC and those of the service provider, the latter take precedence for all aspects relating to the booked service. These GTC nevertheless remain applicable to all matters relating to the use of the shop.nendaz.ch platform and the booking process. In the absence of specific terms and conditions of the service provider, the applicable legal provisions apply to the contractual relationship between the customer and the service provider.
B. Booking services on shop.nendaz.ch
B.1. Conclusion of contract
The customer may create a user account or make a booking as a guest. A personal user account allows all booked services to be viewed at a glance, reservations to be accessed directly and additional services to be booked quickly and easily.
A booking made by the customer constitutes a request to conclude a contract. The contract is deemed concluded upon electronic confirmation of the booking.
If a service is unavailable, the SDN informs the customer within three working days. In such a case, any amounts already paid are refunded using the payment method used at the time of booking.
People with reduced mobility or specific needs are invited to contact the SDN prior to booking (tel. +41 27 289 55 89, info@nendaz.ch) to verify whether the service is suitable for their needs.
For certain services, specific participation conditions may apply. These are indicated in the details of each activity and form an integral part of the contract concluded upon booking.
B.2. Booking and payment
Payment for services contained in the shopping cart is made in Swiss francs (CHF), including VAT, via the payment provider Datatrans AG, Kreuzbühlstrasse 26, 8008 Zurich. The SDN acts as a payment collection agent on behalf of the service provider.
The customer is responsible for any bank charges, credit card fees, or currency exchange fees imposed by their bank, card issuer, or payment provider.
Full payment is required at the time of booking. No services are provided without prior payment.
B.3. Booking multiple services
The customer may add several services to the shopping cart. Each booked service constitutes a separate and independent contract.
The customer selects services under their own responsibility, including their geographical and time coordination. The platform is not in a position to verify whether the selected services are properly coordinated in terms of location and timing.
B.4. Modification of booking
Modification conditions may vary depending on the service and are specified in the product description directly in the online shop. If no conditions are mentioned in the product description, the following conditions apply:
Any modification must be notified to the service provider or organiser no later than 48 hours before the start of the service;
In the event of no-show, late arrival and/or non-use of the services, no refund or alternative service is possible.
Changes of dates are subject to the availability of the service provider. If a customer wishes to change the date of a booking, they may contact the SDN (tel. +41 27 289 55 89, info@nendaz.ch).
Any costs arising from modifications to the services included in the offer are at the customer’s expense.
B.5. Cancellation
In the event of closure, unforeseen unavailability or cancellation by one or more service providers, the amount corresponding to the affected service(s) is refunded to the customer.
Cancellation conditions and fees may vary depending on the service booked. This information is generally indicated directly in the online shop in the description of each service.
In the absence of specific information, the following cancellation rules and fees apply:
Accommodation
If conditions are not specified in the product description, the following cancellation fees apply:
60 days or more before the arrival date: 10%
29 to 59 days before the arrival date: 50%
2 to 28 days before the arrival date: 80%
1 day or less before the arrival date: 100% of the booking price
Activities and experiences
If conditions are not specified in the product description, the following cancellation fees apply:
Up to 2 days before: 10% of the total price
1 day before: 50% of the total price
On the same day: 100% of the total price
Furthermore, all activities with a unit price of CHF 10.– or less are non-refundable. The unit price of each activity applies, regardless of the number of activities purchased or the total amount of the order.
B.6. Force majeure
Neither party can be held liable in the event of non-performance or partial performance of a service due to force majeure, including but not limited to extreme weather conditions, natural hazards, pandemics, decisions by authorities, strikes, major technical failures or infrastructure closures.
In the event of force majeure, the conditions of the relevant service provider apply exclusively, in particular with regard to cancellation, postponement or refund.
No right to any additional compensation or damages may be claimed against the SDN. Where applicable, refund conditions depend solely on the service provider’s terms.
B.7. Insurance
Each participant is required to have adequate personal insurance. No insurance is included in the price of the services.
B.8. Liability
The SDN is not liable for accidents, personal injury, property damage or theft occurring during the execution of services by third-party providers.
The SDN is not liable for indirect damages, financial losses, loss of profit or non-material damages.
Any liability of the SDN is in all cases limited to the amount of the commission actually received for the service concerned.
Information relating to opening hours, public transport, weather conditions or other events is provided for information purposes only. It does not form part of the contract and does not give rise to any liability on the part of the SDN. If such elements are decisive for the customer, it is their responsibility to obtain information directly from the relevant organisations or service providers prior to booking.
Unless the SDN itself organises the service, it is not a party to the contract concluded between the customer and the service provider and assumes no responsibility for the execution of the service. Any claim must be addressed directly to the relevant service provider.
B.9. Availability of the platform
The SDN does not guarantee continuous and uninterrupted availability of the platform and is not liable for any interruption, technical malfunction, payment errors or data loss related to the use of the site.
C. Purchase of merchandising
The online shop also allows the purchase of merchandising items, delivered exclusively to addresses located in Switzerland and Lichtenstein, excluding post office boxes.
The customer is required to check the goods upon receipt and report any obvious defect without delay to info@nendaz.ch. In the event of delivery issues (defective goods, loss during transport or non-delivery), the customer is entitled to a replacement free of defects.
No other right of return or refund shall be granted.
D. Vouchers
Vouchers are valid only for the period indicated at the time of purchase. They are neither refundable nor convertible into cash upon expiry and cannot be exchanged.
E. Data protection
Personal data shall be processed in accordance with applicable Swiss legislation (in particular the Federal Act on Data Protection (FADP) and its implementing ordinance) and the privacy policy available on the website.
Depending on the service, data may be transmitted to service providers acting as independent data controllers.
F. Applicable law and place of jurisdiction
These GTC and the relationships between users of shop.nendaz.ch, customers, their travel companions and the SDN and/or service providers are governed exclusively by Swiss law. The exclusive place of jurisdiction is Nendaz.
The French version of these GTC prevails.
